MediCab Terms of Service

1. Acceptance of these Terms; who may use MediCab

These Terms of Service ("Terms") are an agreement between you and AAYUU SOFTWARE (OPC) PRIVATE LIMITED (CIN: U62099KA2026OPC223028), registered office at Sabari Complex, National Plaza, 24, Field Marshal Cariappa Rd, Shanthala Nagar, Ashok Nagar, Bengaluru, Karnataka 560025 ("MediCab", "we", "us"). They govern your use of the MediCab mobile apps, the caregiver web dashboard, and the medicab.co.in website (together, the "Service").

By creating an account or using the Service, you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Service.

2. What the Service is

MediCab is a household medication-management tool. It helps a family:

MediCab is a technology platform acting on your household's behalf. Your household enters its own medication information, uploads its own prescriptions, and chooses its own pharmacy. MediCab records what you tell it, reminds you as you configure it, and presents your prescription to the pharmacy you choose. The decisions — medical and dispensing — remain with you, your doctor, and your pharmacy.


3. What MediCab is NOT — please read this carefully

MediCab is not a healthcare provider. Specifically, MediCab is:

Always consult a qualified doctor or pharmacist for medical decisions, including whether to start, stop, or change any medicine. Never disregard professional medical advice, or delay seeking it, because of anything in the Service.

In a medical emergency, call 112 (or your local emergency number) immediately. Do not use the Service to seek emergency help.

Drug-interaction flags in the Service are generated with the help of an AI model reasoning over reference information about medicines' active ingredients in our medicine database. Like all AI-generated output, they can contain errors — a flag may be wrong, and a real interaction may be missed. They are not a clinical assessment of you or any member, are not exhaustive, may not reflect a member's specific medical situation, and are not a substitute for your doctor's or pharmacist's judgment. Always confirm interaction concerns with a doctor or pharmacist.


4. The AI "Cabinet Query" feature

The Cabinet Query feature lets you ask questions about medicines your household already owns — for example, "which of my medicines are for fever?" or "what is this medicine used for?"

5. Medicine refills, pharmacies, and fees

Availability: refill coordination is being rolled out city by city and is currently available only in selected cities, beginning with Bengaluru. Where refills are not yet available in your area, you will not be able to place a refill order until a partner pharmacy is live there; the rest of the Service is unaffected.

5.1 Independent pharmacies dispense; MediCab coordinates

Refill orders placed through the Service are fulfilled by independent, licensed local partner pharmacies. These pharmacies are separate businesses. They are not our agents or employees, and we do not control their conduct.

The pharmacy is the dispensing authority. For every order, the pharmacy independently decides — as required of it under the Drugs and Cosmetics Act, 1940 and the Drugs and Cosmetics Rules, 1945 — whether your prescription is valid and whether the medicine may be dispensed. This applies in particular to Schedule H and other prescription-only drugs, which can only be dispensed against a valid prescription. The pharmacy may decline an order, ask for a clearer or newer prescription, or require additional verification. MediCab does not and cannot override a pharmacy's dispensing decision.

5.2 What MediCab does in a refill

When you request a refill, MediCab transmits your order details, delivery address, and (where required) your uploaded prescription image to the pharmacy you choose, and shows you the status of the order. MediCab does not verify, validate, or adjudicate prescriptions.

5.3 Platform fee

MediCab charges an order-processing (platform) fee of 5% of the order value. The exact fee in rupees is displayed at checkout before you pay, and you will never be charged more than the amount displayed there. The price of the medicine itself is set by the pharmacy; MediCab earns no margin on the medicine.

For the cost of the medicine, the partner pharmacy is the seller and merchant of record; MediCab collects that amount on the pharmacy's behalf as its collection agent and settles it to the pharmacy. MediCab is the merchant of record only for its platform fee. Payments are processed by Razorpay.

5.4 Refunds and order issues

Refunds, replacements, and cancellations are governed by our Refund & Cancellation Policy (published at medicab.co.in), which forms part of these Terms. In summary: if your order is not delivered, cannot be fulfilled, is cancelled before dispatch, or the wrong medicine or quantity is delivered, you receive a full refund — including our platform fee. Contact support@medicab.co.in or our WhatsApp support line and we will coordinate resolution with the pharmacy.

Nothing in this Section limits any rights you have under the Consumer Protection Act, 2019.


6. Your responsibilities

Because the Service deals with medication, what you enter matters. You agree that:

  1. Accuracy. You will enter accurate, current information — medicine names, strengths, quantities, schedules, and member details. The Service's reminders, stock forecasts, and safety flags are only as good as the data you enter.
  2. The app is an aid, not a guarantee. MediCab helps your household remember and track medication. It does not guarantee that any dose is taken, that reminders are received (device settings, connectivity, and messaging platforms are outside our control), that stock forecasts are exact, or any health outcome. You remain responsible for the actual taking of medicines and for your household's care arrangements. Do not rely on the Service as the sole safeguard for critical medication.
  3. Account security. You are responsible for keeping your login credentials and device secure, and for all activity under your account. Tell us immediately at support@medicab.co.in if you suspect unauthorised access.
  4. Managing others' data. If you are an admin managing another adult's medication and health information, you confirm that you have that person's knowledge and consent to do so (Section 7).
  5. Acceptable use. You must not use the Service to host, display, upload, modify, publish, transmit, store, update, or share any information or content that:
    • belongs to another person and to which you have no right — including prescriptions that are forged, altered, or not genuinely issued to the member concerned;
    • is obscene, pornographic, paedophilic, invasive of another's privacy (including bodily privacy), insulting or harassing on the basis of gender, libellous, or racially or ethnically objectionable;
    • is harmful to children;
    • encourages money laundering or gambling, or is otherwise unlawful in any manner;
    • infringes any patent, trademark, copyright, or other proprietary rights;
    • deceives or misleads the addressee about the origin of a message, or knowingly and intentionally communicates information that is patently false or misleading but may reasonably be perceived as fact;
    • impersonates another person;
    • threatens the unity, integrity, defence, security, or sovereignty of India, friendly relations with foreign states, or public order, or incites any cognisable offence or prevents investigation of any offence;
    • contains a software virus or any code designed to interrupt, destroy, or limit the functionality of any computer resource; or
    • violates any law for the time being in force.

    You also must not use the Service to obtain medicines unlawfully, misuse another person's identity, probe or disrupt the Service's security, or use the Service for or on behalf of anyone under 18. We may remove content and suspend or terminate accounts that violate this section (see Section 11).


7. Accounts, households, roles, and consent to manage another person's data

The Service is organised around a household with three roles:

Consent within the household. Managing another person's medication is an act of care — and it is also processing of their sensitive personal data. If you add an adult member to your household or manage their treatments:

Caregiver access to a member's data is a specific permission. It applies only to the member for whom it was granted, and it can be revoked at any time in the app.

Caregivers and these Terms. A caregiver who views the caregiver dashboard — including via a share link, without installing the app — is bound by these Terms from their first access. Until the caregiver has accepted these Terms in their own account, the admin or member who granted the access is responsible for ensuring the caregiver uses it only as these Terms allow.


8. Prescriptions


9. Intellectual property

The Service — including its software, design, trademarks, logos, text, and content (excluding the data your household enters) — is owned by AAYUU SOFTWARE (OPC) PRIVATE LIMITED or its licensors and is protected by Indian and international intellectual-property law.

We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your household's own medication management. You may not copy, modify, distribute, sell, reverse-engineer, or create derivative works from the Service, except as permitted by law.

Your data remains yours. The medication information, prescriptions, and records your household enters belong to your household. You grant us only the limited licence needed to process that data to provide the Service, as described in the Privacy Policy.


10. Disclaimers and limitation of liability

Read this section carefully. It limits our liability, subject to Indian law.

10.1 Service provided "as is"

The Service is provided on an "as is" and "as available" basis. We work to keep the Service reliable, but to the extent permitted by applicable law we do not warrant uninterrupted or error-free operation. In particular, we do not warrant that reminders will always reach you where delivery depends on factors outside our control — your device's settings and battery optimisation, your network connection, and third-party platforms such as app-store push services and WhatsApp. We also do not warrant that data entered by users is accurate, or that any pharmacy will accept or fulfil any order.

10.2 What we are not liable for

To the extent permitted by applicable law, MediCab is not liable for:

To the extent permitted by applicable law, our total aggregate liability arising out of or relating to the Service in any 12-month period is limited to the greater of (a) the total fees you paid to MediCab in that period (our platform fees — not the price of medicines, which is paid to the pharmacy) and (b) ₹10,000.

10.4 What this section does not do

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Indian law — including liability arising from our fraud, or your statutory rights and remedies as a consumer under the Consumer Protection Act, 2019, which remain fully available to you. If any part of this Section 10 is held unenforceable, the remainder continues to apply to the maximum extent permitted.


11. Suspension, termination, and account deletion


12. Governing law and jurisdiction

These Terms are governed by the laws of India. The Service is directed at the management of medication for households located in India; users who access the Service from outside India do so on their own initiative. Subject to any mandatory consumer-protection rights that let you bring proceedings elsewhere, the courts at Bengaluru, Karnataka have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Service.

Nothing in this Section prevents you from filing a complaint before a Consumer Disputes Redressal Commission having jurisdiction under the Consumer Protection Act, 2019.

14. Changes to these Terms

We may update these Terms as the Service or the law changes. For material changes, we will notify you in the app and/or by email before the change takes effect. Continuing to use the Service after the effective date constitutes acceptance of the updated Terms; if you do not accept them, stop using the Service and delete your account. The "Last updated" date at the top reflects the current version.

Support is WhatsApp-first. We aim to respond within a few hours during business hours (IST) and prioritise anything where a patient risks running out of essential medication. Response-time aims are targets, not guaranteed service levels.
